The court ruled that “the appraisal presented by the bereaved family was only a privately commissioned ‘private appraisal’ and could not guarantee fairness and objectivity.”
Previously, the first trial had also been dismissed for reasons such as judgement.
The ‘Busan Santa Fe accident’ occurred on August 2, 2016, at 12:30 p.m., in Gamman-dong, Nam-gu, Busan, when a Santa Fe vehicle carrying five members of a family who were going to play in the water sped up from the bottom of the hill and then raced without slowing down during a left turn, hitting a trailer parked on the shoulder of the road. The driver, his wife, daughter, and two grandchildren were killed in the accident.
The driver’s wife and daughter were each carrying two children without car seats, and the older child, aged 3, was ejected from the vehicle on impact.
The driver claimed that he had been delivering parcels and driving taxis for nearly 30 years, and that his vehicle had been regularly maintained.
The car’s dashcam recorded a voice 300 metres before the accident saying, “Chaga wa irano. I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry, I’m sorry.
